BUILDER

Terms

Effective October 26, 2026.

These terms are an agreement between you and SOEngineered LLC ("we", "us"), the company behind Kids Game Builder. They cover this site (https://kidsgamebuilder.com), the free arcade (https://kidsgamearcade.com) and everything on them (together, the "Service"). They have three parts: Part 1 covers the free arcade, Part 2 covers the paid Family Plan, and Part 3 applies to both. By using the Service you agree to these terms. Last updated 2026-10-27.

Part 1: The free arcade

1. Who can use it

The arcade is made for kids, played with the permission of a parent, legal guardian or teacher. If you are a kid, please ask a grown-up to read these terms with you. If you are a parent or guardian, you accept these terms for yourself and for your kids, and you are responsible for how they use the Service. If you let kids use it in a school, club or library, you accept these terms on behalf of that organisation and agree to supervise its use.

2. Your licence to play

The games are free. We give you a personal, limited, non-exclusive, non-transferable and revocable licence to play them in a web browser, and to add the arcade to a home screen, for personal, family and classroom use that is not commercial. You may show the games in a classroom, project them for a group and print our free lesson materials for your own students. Anything we don't expressly allow here is reserved to us.

3. Things you agree not to do

  • Copy, download, re-host, mirror, frame or embed the games, artwork or site on another site or app, or sell or rent access to them.
  • Modify, decompile or reverse engineer the games, or remove copyright, credit or ownership notices, except as the law allows despite this restriction.
  • Cheat the high scores: submit scores you didn't earn, use scripts or bots, or tamper with requests.
  • Scrape, crawl or overload the Service, probe or break its security, or get around any limit we set.
  • Use the Service to break the law, or to harass, bully or harm anyone.
  • Use our names, logos or games to suggest we endorse you, or to train or build other products or AI models.

4. High scores

A player can save three letters (initials) with a high score. Saved initials and scores are public on the Top 10. Please don't use real initials if you'd rather not. By saving a score, you let us store, display and remove it as part of the Service. We may remove any initials or score at any time, including any that are unkind, look like a name, or seem to have been earned by cheating, and we delete any score a parent asks us to.

5. Who owns what

SOEngineered LLC owns the Service and everything in it, including the games, code, characters, artwork, sounds, music, text, the names "Kids Game Builder", "Kids Game Arcade", "Goat Climb", "Turkey Flight" and "Kai Po Che!", our logos, and the look and feel of the site. They are protected by copyright, trademark and other laws. Games made by kids and published through the Family Plan belong to us as set out in Part 2. Credits shown on a game (for example "by Jenn") recognise who made or inspired it and don't transfer any rights.

6. Ideas and feedback

If you send us ideas, suggestions or feedback, we may use them freely, without owing you anything. Please don't send anything you want to keep confidential, and never send a child's personal information.

7. Kids' privacy

The free arcade does not ask for or collect personal information from kids. See our privacy notice. The Family Plan has its own kids' privacy notice under the Children's Online Privacy Protection Act (COPPA). If you believe a child has sent us personal information, tell us and we'll delete it.

8. Other sites

The Service may link to other sites, such as an app store or a page about how something works. We don't control them and aren't responsible for them. Their own terms and privacy notices apply.

9. Changes to the arcade

We may add, change, pause or remove any game, feature or part of the Service at any time, with or without notice, and we may limit or end anyone's access if we reasonably believe they have broken these terms.

Part 2: The Family Plan

These terms cover the Kids Game Builder Family Plan, a paid service from SOEngineered LLC that lets your kids build their own games with an AI helper. Part 1 (the free arcade) and Part 3 (general terms) also apply.

The plan

The Family Plan is a yearly subscription to the Kids Game Builder service, billed in advance by Stripe, for up to the number of kids shown at sign-up. Its price and monthly allowance of sparks are shown on the sign-up page; your family page shows your current allowance, and your renewal notices show the price. Sparks measure how much AI work the builder does; different requests use different amounts, so the allowance isn't a promise of a number of games or changes. Unused sparks don't roll over and have no cash value. We may change the plan, its price, its sparks and limits, and how the builder works; price changes apply at your next renewal after we tell you. It is available to families in the United States, set up by a parent or legal guardian; a payment with a billing address outside the US is refunded in full.

The trial

New families may start with a trial, at the price and for the length shown at sign-up, charged when you sign up. The trial is the full plan. When it ends your plan starts and your first year is charged at its price, or at your offer code's price, unless you cancel before then. Before the trial ends, our payment processor, Stripe, emails you the date, the amount and how to cancel. Cancelling during the trial ends it with no further charge; the trial price isn't refunded. You can start your plan early from your family page. One trial per card: if your card has already had one, we refund the trial price and you can start the plan straight away.

Automatic renewal

Your plan renews automatically every year at the then-current price, charged to your card on file, until you cancel. At least 15 days before each renewal, Stripe emails you the date, the amount and how to cancel. If the price ever changes, we'll tell you by email before you're charged.

Cancelling and refunds

  • Cancel any time on your family page under "Manage subscription". Your plan stays on until the end of the year you've paid for, and you won't be charged again.
  • If you pay but don't give your consent for your kids, you can cancel right away for a full refund.
  • If you delete your family, the plan is cancelled and your kids' data is removed.
  • If your plan ends and isn't restarted, we delete your kids' profiles, games and history 6 months later, and email you 30 days before that.
  • Changed your mind? Within 14 days of any yearly payment, including a renewal, we'll refund that payment in full and end the plan: send us a message. After 14 days, payments aren't refundable, but your plan stays on until the end of the year you paid for.

Offer codes

From time to time we offer codes, such as a founding-family or launch price. A code's price, how many yearly payments it covers and any limits are shown on the sign-up page before you pay, and the renewal terms next to the checkbox state exactly what you'll be charged at each renewal. Unless a code says otherwise: one code per family, only at sign-up; the offer price applies only while your plan stays on without a break (if you cancel and come back later, the normal price applies); after the offer's years end, your plan renews at the normal yearly price; codes have limited spots and an end date and can't be exchanged for cash. We may end an offer for new sign-ups at any time; that never changes the price of a plan already started with it. Offer codes don't change your monthly sparks.

Extra sparks

A parent can buy extra sparks on the family page, in the packs and at the prices shown there. Each purchase is a one-time charge to the card on file, made only after you confirm the price and the card. Extra sparks are used after your monthly sparks run out, last for the time shown when you buy them, belong to your family and can't be transferred or exchanged for cash. You can ask for a full refund of a pack you haven't started using within 14 days of buying it. Kids can't buy sparks. We may limit how many a family buys in a day. If you delete your family, unused extra sparks are lost.

Your kids' use

You consent for your kids and agree to supervise their use. Kids use the builder only on devices you pair, and only for making games. Please don't let them share personal information, and don't use the builder to make anything unkind, unsafe or that copies someone else's work. The AI helper can make mistakes; tell us if it does (kids can use /report). We may pause a kid's building if these terms are broken.

The games

Your family can keep and play the games your kids make. Nothing goes in the arcade unless you submit it and we approve it.

Review. Every game you submit is reviewed before it goes live. While we review it we may play it, change it and fix it, and we may send it back or decline it, with or without a reason.

Published games are ours. If we publish a game, you transfer to SOEngineered LLC, on your own and your kid's behalf, all rights in it: its code, pictures, sounds, text and title. From then on we may revise it as needed (change, fix, rename, improve or combine it), publish and promote it anywhere, and take it down, at any time and without payment. If you chose to, we credit your kid's nickname, and we may change or remove credits. As far as the law allows, you give up any right to be named or to object to changes. Your family can keep playing its own copy in the builder.

Your promise. When you submit, you confirm the game has no personal information and doesn't copy anyone else's work.

Privacy

How we handle your kids' information is in the kids' privacy notice.

No warranty and limits

The AI helper and the builder are provided "as is" and may change. The games it makes may have mistakes, and you review what your kids make before sharing it. The warranty disclaimer, the limits on our liability, and the law and disputes terms in Part 3 apply to the Family Plan.

Changes and transfers

We may update these terms. We'll post the new version here and email you about material changes before they take effect; if you don't agree, you can cancel before they apply. We may transfer the Family Plan and these terms to a successor, such as a buyer of our business, who will take on our obligations to you under them. Your kids' information stays covered by the kids' privacy notice they were collected under.

Part 3: General terms

These apply to the whole Service, including the Family Plan. If Part 2 says something different about the Family Plan, Part 2 wins for the Family Plan.

10. No warranty

We work hard to keep the Service safe, working and suitable for kids, but it is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure or free of harmful components, or that scores or games will be kept. Some places don't allow these exclusions, so some of them may not apply to you.

11. Limits on our liability

To the fullest extent the law allows, SOEngineered LLC and its owners, employees, contractors and providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost data, lost profits or lost goodwill, arising from or related to the Service or these terms, however caused and even if we were told they were possible. Our total liability for all claims about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and fifty US dollars (US$50). Nothing in these terms limits liability that can't be limited by law, such as for fraud or for death or personal injury caused by negligence.

12. Your responsibility to us

If you are an adult (or an organisation) using the Service, you agree to defend and compensate SOEngineered LLC for claims, losses and reasonable costs (including legal fees) that third parties bring because you, or kids you are responsible for, broke these terms or the law while using the Service.

13. Ending these terms

You can stop using the Service at any time. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering the Service. Sections 5, 6 and 10 to 16 continue after these terms end.

14. Changes to these terms

We may update these terms from time to time. We'll post the new version on this page with a new date, and for material changes to the Family Plan we'll email you before they take effect, as Part 2 describes. If you keep using the Service after a change takes effect, you accept the updated terms.

15. Law and disputes

These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally within 30 days. Any dispute that isn't resolved that way will be decided in the state or federal courts located in Bristol County, Massachusetts, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small claims court where you live. If you live somewhere whose consumer laws give you rights these terms can't take away, those rights still apply.

16. The rest

  • Transfers. We may transfer these terms and the Service, in whole or in part, to an affiliate or to a successor, such as a buyer of our business or its assets, in a merger, acquisition, reorganisation or sale. You may not transfer your rights under these terms without our written permission.
  • Whole agreement. These terms, the privacy notices and any terms shown when you buy the Family Plan are the whole agreement between you and us about the Service.
  • If part doesn't hold. If a court finds part of these terms unenforceable, that part is limited as little as possible, and the rest stays in effect.
  • No waiver. If we don't enforce a term right away, we can still enforce it later.
  • Events beyond our control. We aren't responsible for delays or failures caused by events we can't reasonably control.
  • Plain language. Headings and examples are there to help you read; they don't limit what a section says.
